Even if you have already completed your Probation, you may be eligible for an Expungement pursuant to Penal Code Section 1203.4. If granted, you can truthfully respond “No” to the question: have you ever been convicted of a crime? Often, Penal Code Section 1203.4 Motions are filed together with a Motion to Terminate Probation Early and if convicted of a felony, a Penal Code Section 17(b) Motion to Reduce the Felony to a Misdemeanor.
If granted, your original plea of guilty or no contest is withdrawn and a plea of not guilty entered in its place and the case dismissed.
